RE: Volunteers under 49 CFR Parts 653 and 654.

Dear Mr. Raphael:

Thank you for your letter asking that the Federal Transit Administration (FTA) reconsider the coverage of volunteers under its drug and alcohol testing rules.

FTA recently published a Notice of Proposed Rulemaking (NPRM) proposing to exempt volunteers from the application of its drug and alcohol testing rules. A copy of the NPRM is enclosed. Pending review of the record, FTA intends to issue a final regulation on this matter sometime after the comment period closes on April 7, 1995.

We have filed your letter in the docket, and we would welcome any further comments you may have.
